Referral Program Terms & Conditions

1. Introduction & Acceptance

These Referral Program Terms & Conditions (“Referral Terms”) govern participation in THETRUETRADE (“THETRUETRADE”) Referral Program.

By generating, sharing, or using a THETRUETRADE referral link, code, or referral dashboard, you acknowledge and agree to these Referral Terms, together with the THETRUETRADE Platform Terms & Conditions, Privacy Policy, and any related promotional or campaign rules published by THETRUETRADE.

Participation in the Referral Program is entirely voluntary and subject to ongoing compliance with all applicable Platform policies and legal requirements.

2. Eligibility

To participate in the Referral Program, users must:

Hold an active THETRUETRADE account in good standing and with completed KYC;
Be at least eighteen (18) years of age or the age of legal majority in their jurisdiction;
Not reside in or access the Platform from a prohibited or restricted jurisdiction;
Comply with all applicable laws, regulations, sanctions, and marketing requirements;
Comply with the THETRUETRADE Platform Terms & Conditions, Privacy Policy, Referral Program Terms, and all related Platform policies and compliance requirements.

THETRUETRADE employees, contractors, market makers, affiliates, or related parties may be restricted from participation at THETRUETRADE’s discretion.

3. Referral Program Structure

Eligible users may receive referral commissions generated from the qualifying trading activity of referred users (“Referees”).

Referral commissions:

Are calculated based on eligible trading fees generated by Referees;
May vary depending on campaign, account level, or promotional structure;
Are credited to the Referrer’s THETRUETRADE account balance;
May be settled in the same asset used to pay trading fees, typically USDT (CEX) or USDC (Web3);
Are subject to verification, fraud checks, and compliance review.

Referral commission rates, payout schedules, duration periods, and eligibility requirements may be modified, suspended, or discontinued by THETRUETRADE at any time.

Referral commissions apply to eligible perpetual futures trading activity across both CEX and DEX trading modes, with no minimum or maximum trading volume requirement unless otherwise specified by THETRUETRADE.

All referral commission calculations are based on THETRUETRADE’s active trading fee structure, including eligible maker and taker trading fees generated by referred users.

Referral rewards:

Are calculated from eligible trading fees paid by referred users.
Are typically settled in the same asset used to pay trading fees, usually USDT (Exchange) or USDC (Web3).
Are distributed once daily based on UTC settlement time.
Remain active for up to 365 days from the referred user’s registration date.

If a referred user reaches VIP Level 3 or higher, additional referral commissions from that user may no longer apply.

THETRUETRADE may provide optional commission-sharing or cashback functionality, allowing Referrers to share part of their referral commissions with invited users directly to their THETRUETRADE account balances.

Commission rates, cashback ratios, payout schedules, earning duration, and eligibility requirements may be adjusted, recalculated, suspended, or modified by THETRUETRADE at any time based on Platform policies, referral performance, risk controls, account status, or promotional structures.

4. Qualifying Activity

Referral rewards apply only to valid and qualifying activity determined by THETRUETRADE.

THETRUETRADE reserves the right to exclude:

Wash trading;
Artificial volume generation;
Self-referrals;
Coordinated trading schemes;
Manipulative or abusive activity;
Accounts violating Platform Terms or compliance policies.

THETRUETRADE’s internal records and calculations shall govern all referral reward determinations.

5. Referrer Responsibilities

By participating in the Referral Program, you acknowledge and agree that:

You act independently and not as an employee, agent, representative, or partner of THETRUETRADE;
You may not bind or legally represent THETRUETRADE in any manner;
You must clearly disclose that referral commissions may be earned from referred users;
You must not make misleading, deceptive, or exaggerated claims regarding THETRUETRADE, trading performance, profitability, fees, bonuses, or platform functionality;
You are solely responsible for compliance with advertising, marketing, tax, financial promotion, and consumer-protection laws applicable in your jurisdiction.

Referral marketing involving perpetual futures trading, leverage, or digital assets must include appropriate risk disclosures where legally required.

6. Prohibited Conduct

The following conduct is strictly prohibited and may result in commission cancellation, account restriction, suspension, or permanent disqualification:

Self-referrals or multi-account abuse;
Fake accounts, bots, or automated registration systems;
Wash trading or artificial trading volume generation;
Misleading marketing or false statements;
Spam, unsolicited advertising, or abusive promotion;
Circumvention of geographic or compliance restrictions;
Unauthorized incentive schemes or rebate sharing;
Any illegal, fraudulent, manipulative, or deceptive conduct.

THETRUETRADE reserves the right to investigate and take enforcement action against suspected abuse at its sole discretion.

7. Compliance & KYC

THETRUETRADE reserves the right to require identity verification (“KYC”), AML screening, source-of-funds verification, or enhanced due diligence procedures for Referrers or Referees at any time.

Referral rewards may be delayed, restricted, frozen, adjusted, or cancelled pending compliance review, fraud investigation, sanctions screening, or legal obligations.

Users located in restricted jurisdictions may not participate in the Referral Program.

8. Payments, Taxes & Adjustments

Referral rewards are credited to the Referrer’s THETRUETRADE account according to applicable payout schedules and internal settlement procedures.

Minimum withdrawal thresholds, payout delays, risk reviews, or operational restrictions may apply.

Users are solely responsible for determining, reporting, and paying all applicable taxes associated with referral earnings.

THETRUETRADE reserves the right to:

Correct calculation errors;
Reverse incorrectly distributed rewards;
Adjust commission balances;
Suspend payouts during investigations or disputes.

9. Intellectual Property & Branding

Participation in the Referral Program does not grant ownership or licensing rights in THETRUETRADE’s trademarks, branding, content, or intellectual property except for limited use strictly necessary to share official referral materials or referral links.

Users may not impersonate THETRUETRADE or represent themselves as official representatives of the Platform.

10. Limitation of Liability

THETRUETRADE does not guarantee:

Referral earnings;
Platform availability;
Continuous Program operation;
Any minimum level of trading activity by referred users.

To the fullest extent permitted by law, THETRUETRADE shall not be liable for:

Lost commissions;
Trading losses;
Indirect or consequential damages;
Delays, interruptions, or technical failures affecting referral tracking or payouts.

11. Modifications & Termination

THETRUETRADE reserves the right to modify, suspend, restrict, or terminate the Referral Program, any referral structure, reward system, commission model, or eligibility requirement at any time with or without notice.

Continued participation after updates constitutes acceptance of revised Referral Terms.

12. Governing Law & General Provisions

These Referral Terms form part of the THETRUETRADE Platform Terms & Conditions and shall be governed by the same governing law, dispute-resolution procedures, and arbitration provisions.

If any provision of these Referral Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

These Referral Terms, together with the Platform Terms & Conditions, Privacy Policy, and related Platform policies, constitute the complete agreement relating to the Referral Program.
